Purchaser and Breeder agree to the sale of the cat herein described, subject to the following terms and conditions;

1. The Purchaser agree, to the purchase price of $ .00 Show, Pet, Alter, Birman female.

2 If as stipulated in paragraph two (2), this cat is an alter (no breeding rights, must be spay or neuter), the Purchaser agrees to neuter or spay this cat between six to ten months of age. Purchaser is in breach of this agreement, should this cat be bred where by the Breeder has the right to take back ownership of this cat, plus any progenies, without a refund to Purchaser. Purchaser further agrees, to provide the Breeder with a certificate of spay or neuter, by a qualified and licensed veterinarian, as proof of this cat being altered. Breeder will retain registration papers and pedigree until proof of altering has been established.

3. If as stipulated in paragraph two (2), this cat is a breeder, the Purchaser agrees, to breed this cat exclusively to cats of the Birman breed, with pedigrees consisting of three generations of Birmans. Should a breeding of this cat to a non-Birman occur, the purchaser agrees to alter all the offspring, and provide the Breeder with written evidence of altering by a qualified and license veterinarian before the offspring reaches ten months of age.

4. Purchaser agrees not to authorize or permit the performance of any procedure to remove the cats claws.

5. Purchaser agrees; under no circumstances will this cat be sold, leased or given to any pet-shop, research laboratory animal shelter or similar facility.

6. Purchaser agrees to provide & care: indoor sanitary facilities, food & water, medical and never allowed the cat to roam outdoors or come into contact with any other animal.

7. Purchaser agrees, before any subsequent disposition, transfer of ownership or housing of this cat, i.e.. sales, gift or otherwise, the purchaser must first obtain from the Breeders written permission and provide the Breeder with he name, address and phone number of the proposed new owner. The new owner must except in writing all the terms and condition of this agreement. Breeder has the right to repose the cat without refund if Purchaser fails to inform and obtain written prior approval.

8. The breeder has sold this cat free from apparent clinical signs of contagious or infectious disease(s) and believes this cat is free of life threatening genetic defects. Seven day return policy; if Purchaser believes this cat to be sick, the Breeder will replace the cat with one of equal value. If the Purchaser takes the cat to the Veterinarian during the seven day period without first consulting with the Breeder and obtaining her written approval, any expenses incurred shall be the responsibility of the Purchaser. Furthermore, any veterinary expenses incurred after the initial seven day period are the sole responsibility of the Purchaser. The Breeder does guarantee that the cat will test negative for FELV and FIV within seven days of purchase. Due to changes in the cat's environmental surroundings, the Breeder can not guarantee the cat's health beyond the first seven days. It is in your best interest to have the cat examined and tests performed by your Veterinarian within seven days of purchase.

9. Breeder guarantees; should this cat die prematurely from a life threatening genetic defect as determined by an ecrocpy performed by a license qualified veterinarian, the Breeder will replace the cat, upon availability, with one of equal value; providing that the Purchaser is not in default of this agreement.

10. Purchaser agree that if the Purchaser fails to comply with the terms of this agreement, the Breeder has the right to repossess the cat, without refund of purchase price. Should It become necessary to bring to litigation before a court of law, the Purchaser shall be liable and responsible for any court costs and attorney fees. Purchaser agrees that Jurisdiction over disputes between the two parties herein, shall be held within the County of Ventura, in the State of California.

11. This agreement shall endure to the benefit of and binding upon the Parties to this agreement, and their heirs, executors, administrators, successors and assigned; the term Purchaser as it appears herein include any subsequent owner of the cat.
